What Is a Trademark and Why Is It Important to Register It in Colombia?

A trademark is a sign capable of distinguishing the goods or services of one business from those of others in the marketplace. In addition to enabling consumers to identify their commercial origin, a trademark may embody the reputation, trust and qualities that the public associates with a particular offering. In Colombia, the exclusive right to a trademark is acquired through registration with the Colombian Superintendency of Industry and Commerce (SIC).

What function does a trademark perform?

The essential function of a trademark is to distinguish goods or services. It enables consumers to recognize an offering, differentiate it from others and associate it with a particular experience, level of quality or reputation. A trademark is therefore more than merely a name or image: it is a means of identifying a business and communicating in the marketplace.

A well-chosen trademark used consistently can help build recognition, trust and loyalty. Its commercial value will depend, among other factors, on its recognition, reputation, use, market positioning and ability to differentiate the company’s offering. It may therefore become one of the company’s most valuable intangible assets.

What is the difference between a trademark and other distinctive signs?

A trademark identifies and distinguishes goods or services. It should not be confused with other distinctive signs. A trade name identifies a business activity or enterprise; a business sign identifies a commercial establishment; a slogan is a word, phrase or expression that complements a trademark; and an appellation of origin identifies a product whose quality, reputation or other characteristics are essentially or exclusively attributable to its geographical origin, including natural and human factors.

Nor should trademark registration be confused with commercial registration or the registration of a company name with a chamber of commerce. Incorporating a company or registering a commercial establishment does not, in itself, confer the exclusive right to a trademark. These procedures serve different purposes and have different legal effects.

Why is it important to register a trademark in Colombia?

Decision 486 of the Andean Community provides that the exclusive right to use a trademark is acquired through registration with the competent national office. In Colombia, that authority is the SIC. Registration allows its owner to commercially exploit the trademark and, within the scope of the protection granted, prevent certain unauthorized uses of identical or similar signs that may infringe its rights.

The principal advantages of trademark registration include:

  • Securing an exclusive right: the owner may exercise the rights and remedies afforded by law against unauthorized uses.
  • Differentiating the offering: registration helps consumers identify the goods or services and distinguish them from those offered by other businesses.
  • Protecting the investment: it reduces the risk that third parties may seek to appropriate the sign or improperly benefit from its reputation.
  • Commercially exploiting the asset: a registered trademark may be licensed, assigned or used in franchise arrangements, subject to the applicable law.
  • Supporting business expansion: a well-planned protection strategy facilitates growth into new goods, services or markets.
  • Providing a basis for enforcement: registration provides the foundation for pursuing the remedies available under trademark law against potential infringements.

Registration does not confer an absolute monopoly over every use of a word, image or element. The scope of protection depends on the registered sign, the goods or services covered and the legal circumstances of each case. Accordingly, before filing an application, it is advisable to assess prior trademark rights and properly define the scope of protection sought.

What can happen if a trademark is not registered?

Trademark registration is not generally required in order to conduct business, and failure to register does not, in itself, result in a fine. However, operating without registered trademark protection may expose a business to significant legal and commercial risks.

If a third party adopts or applies first for an identical or similar sign, a business that has not secured registration may face greater difficulty in protecting its identity. Depending on the circumstances, it may be required to pursue legal proceedings, modify its trademark, replace advertising materials, change domain names or digital profiles, and rebuild some of the recognition it has achieved. Although other avenues of protection may be available in certain cases—for example, those relating to trade names, unfair competition or previously acquired rights—their availability requires a case-specific analysis and does not replace the benefits of trademark registration.

Early protection is usually more efficient than subsequently facing a dispute or undertaking a rebranding process. Before investing in advertising, packaging, signage, digital platforms or commercial expansion, it is advisable to verify the availability of the sign and promptly begin the process for registering the trademark in Colombia.

The trademark as a business asset

The legal protection and commercial management of a trademark should proceed in a coordinated manner. Registering the sign is a fundamental decision, but its value is also built through consistent use, maintaining quality, monitoring the market and renewing the registration in a timely manner. An appropriate trademark strategy helps preserve the company’s identity and strengthen customer trust.

In addition, Law 603 of 2000 requires company directors to include in the management report information concerning the company’s compliance with intellectual property and copyright laws. This obligation underscores the importance of properly identifying, protecting and managing the company’s intellectual property assets.
