Types of Trademarks in Colombia

What types of trademarks exist according to their composition?

In Colombia, a trademark may consist of words, combinations of words, images, figures, symbols, graphics, logos, monograms, letters, numbers, colours, product shapes, containers or packaging, among other signs. To be registrable, the sign must be capable of distinguishing goods or services in the marketplace and comply with the applicable requirements of Andean law.

Depending on how the sign is composed, trademarks may be word, figurative, mixed or three-dimensional marks.

Word marks

Word marks consist solely of letters, numbers or combinations thereof that form a legible and pronounceable expression. Their protection lies in the word element itself, irrespective of any particular typeface, colour or graphic design.

Figurative marks

Figurative marks consist exclusively of a figure, symbol, design or set of graphic elements that does not include a pronounceable word element. Protection is focused on the visual elements that identify the sign.

Mixed marks

Mixed marks combine one or more word elements with one or more figurative elements. In these cases, registration protects the specific manner in which the words, letters or numbers are combined with the graphic elements submitted in the application.

Three-dimensional marks

Three-dimensional marks are signs that occupy the three dimensions of space. They may consist of the shape of a product or of its container, packaging or wrapping, provided that the shape is distinctive and does not consist exclusively of a functional or necessary characteristic of the product.
